Response to the outstanding office action

When

Three months from the issue date for most applications filed on or after 3 December 2022, extendable once by three months for a fee.

Extensions and grace

A Madrid Section 66(a) application keeps a six-month response period instead, with no extension available.

If it is missed

The application goes abandoned. A petition to revive runs two months from the notice of abandonment, on an unintentional-delay standard.

General information about USPTO practice, not legal advice. The register is the authority, and a filing that has not yet posted can change what is owed.
